Maximizing free speech requires an operating standard that can be applied consistently across the board to everyone! The standard that I continue to use is the sticks and stones standard. That is to say you can say what you will but you can never physically hurt anyone. It is NOT a perfect standard.
Hate speech on the other hand is highly subjective and very dependent on hurting someone feelings. A recent survey found that 72% thought that it was okay to be white while 28% thought otherwise. 48% of black’s surveyed thought it wasn’t okay to be white! Okay 48% of black folks you hurt this crackers feelings, so freeze you’re under arrest for hate speech!
