If Obama could appoint whomever he wished without Senate approval then so be it but he can’t, so short of eliminating the filibuster he could have ideally compromised and appointed 45 judges that were okay with the Republicans who held 45 Senate Seats or at a minimum appointed 5 judges that could have changed 5 Republican Senator votes but he didn’t want to do that either!
