No Jussie No Peace

“Today we resolve a question about the State’s responsibility to honor the agreements it makes with defendants,” the court wrote in documents obtained by Fox News Digital. “Specifically, we address whether a dismissal of a case by nolle prosequi allows the State to bring a second prosecution when the dismissal was entered as part of an agreement with the defendant and the defendant has performed his part of the bargain. We hold that a second prosecution under these circumstances is a due process violation, and we therefore reverse defendant’s conviction.” CNN

This is similar to the Bill Cosby decision by another State Supreme Court (PA) that found that Cosby had a deal from a local prosecutor and like Smollett couldn’t be tried and convicted for a second time! In both of those cases they had been found to be guilty of the crime they were accused of having committed. The Cosby was a #Me too driven case while Smollett was driven by him accusing his attackers of wearing MAGA hats.

And this is all I’m going to say about that!
